I’ve received a DMCA Notice From Takedown Piracy

So you’ve received a DMCA notice from Takedown Piracy.  Now what should you do?

#1 thing is to comply.  Just remove the content that we’ve identified and you can make things a whole lot easier for everyone involved.

Know that any DMCA notices that go unanswered do get escalated.  We will resubmit the DMCA notice to your webhost and upstream providers as well as any advertisers your site might have.  This typically can result in you getting your website taken down by your host.

We also work closely with several attorneys with a successful track record in prosecuting copyright infringement.  Regardless if you are based in the United States or not, you can be prosecuted and you will in all likelihood lose.  It’s not worth the risk, just comply.

The next thing you should do is to stop allowing content from our clients on your website.  If you are the one uploading it, stop doing it.  If your users are uploading it, add our clients name to a list of Forbidden Content and do not allow it to be uploaded.  This will go a long way in showing our clients that you are serious about not infringing their copyrights in the future.

Rest assured, our DMCA notices are 100% accurate, legal and binding.  To not comply means you are forfeiting your Safe Harbor protections and can now be sued by our client with a penalty of up to $150,000 per infringement.

It’s not worth it, just comply.
